Miner dies in West Virginia coal mine and family sues Consol for his death
CHARLESTON, WV – A Consol Energy ditch-digging machine lurched forward and ripped off Charles McIntire’s leg as it lurched forward out of control. Mr. McIntire of Shadyside, Ohio, died on Oct. 17, 2011, as a result of the incident. He was 62 years old.
Mr. McIntire’s daughter filed a wrongful death lawsuit against Pennsylvania based Consol Energy. The lawsuit says Consol failed to conduct safety hazard inspections, failed to keep the machine in safe operating condition and failed to ensure it had emergency shut-off switches.
The WV mine safety office issued two violations to Consol related to the equipment involved in Mr. McIntire’s death.
The complaint was originally filed in Marshall County, WV Circuit Court, but Consol recently transferred the case to the U.S. District Court in Wheeling.
