Nursing Home Negligence Lawsuit Against WV Genesis Putnam Center

Hurricane, WV – An elderly woman suffered serious injuries after falling at Genesis Putnam Center. As a result, a nursing home neglect lawsuit was filed on March 7, 2022, in the Circuit Court of Putnam County, West Virginia, against Sunbridge Putnam Health Center, LLC doing business as Genesis Putnam Center. Genesis Healthcare owned, operated, managed, and controlled Putnam Center located in Hurricane, West Virginia.
The nursing home lawsuit filed by Roy L. Marcum, II, as power of attorney for Anita Marcum, alleges that during her stay, she suffered a fall, resulting in an acute left hip fracture that required surgical repair. “During her residency at Putnam Center, Defendant failed to provide a safe environment for Anita L. Marcum. Defendant failed to provide adequate supervision and safety devices to prevent Anita L. Marcum from suffering a fall incident on March 5, 2021 that resulted in an acute left hip fracture with surgical repair,” the complaint alleges. Ms. Marcum had been a resident of Putnam Center for rehabilitation since about October 15, 2020.

Among other things, the nursing home neglect lawsuit alleges the defendants failed to provide a safe environment and adequate supervision, had deficient staff, and did not provide care and treatment in compliance with state law, which allegedly caused Anit’s fall and serious injuries.
“Defendants’ acts and omissions during the relevant time period also violated Anita L. Marcum’s right to be treated courteously, fairly and with the fullest measure of dignity,” the complaint states.
The complaint alleges statutory violations, negligence, ordinary negligence, and reckless misconduct. The complaint requests prays for compensatory and punitive damages to the plaintiff due to the defendant’s misconduct. “As a direct and proximate result of the breaches of the Defendants during Plaintiff’s treatment with Putnam Center Plaintiff sustained bodily injuries resulting in pain and suffering, mental anguish, inconvenience, physical impairment, loss of capacity for the enjoyment of life, aggravation of existing diseases and physical defects, and incurred medical expenses. The actions and omissions alleged above were willful and arise to the level of reckless, wanton disregard and punitive damages are warranted,” the complaint further alleges.
